What workers over 40 should know about age discrimination in the workplace

The Age Discrimination Act (ADEA) protects workers over 40 from discrimination on the basis of age.  Age discrimination can be difficult to prove however, and circumstantial evidence is important.

If you think that you are the victim of age discrimination, keep careful notes (outside of work) of the things that you find might indicate age discrimination: agist comments, being passed over for promotion in favor of younger workers, etc.

Keep in mind that the law does not forbid employers from taking action against those over 40, it only forbids taking action against those over 40 because they are over 40.
