Discovery is the process of acquiring information from the other side regarding your case. That will almost always involve some number of depositions. A deposition is a question and answer session held between the parties under oath and in the presence of a court reporter who creates a transcript.
You will be deposed. You must tell the truth. One of the important purpose of a deposition is to catch the other side in a lie at trial. If you testify to something at trial that is different from what you said in deposition, opposing counsel will use the deposition transcript to call you a liar, and the jury may then disbelieve everything you say – which means you will lose your case. I will help you to prepare for the deposition but keep in mind – you must tell the truth at all times, even about things that do not seem to matter much to your case.
We will take depositions of witnesses for the defendants and sometimes third parties. Depositions are an important part of preparing your case for trial, but they are expensive.
